TAX FACTS:
- Each year, the IRS reports that refunds to individuals are reduced by billions of dollars because of self-filed taxes.
- Individuals spend hours of time and stress each year completing their taxes.
- The Trump Tax Cuts did not make filing income taxes easier.
- The tax-return loan offered by many store-front tax services, is not allowed.
- The IRS delays individual tax refunds to assist in their efforts to reduce tax fraud.
- To file joint-married, you have to be married to the person on 12/31 of the year you are filing.
- If divorced, and the non-custodial parent is allowed to take the child exemption in any year, the non-custodial parent must attach a copy of the original written declaration for each taxable year (form 8332) the non-custodial parent is taking the exemption. The parent giving up the exemption must sign form 8332 and give it to the other parent.
FILING FOR THE CHILD TAX CREDIT, EDUCATION CREDIT, AND EARNED INCOME TAX CREDIT :
- The IRS has implemented stiff regulations, guidelines, and penalties on tax preparers who file the child credits for their clients.
- To file for any of the tax credits, the tax payer must provide the tax preprarer the following:
- written documentation of the child's residence: copy of the Judgment of Divorce or Custody agreement or Order, medical records or school records or report card showing child's address, and if requested, as copy of the child's birth certificate. The documents are to verify the child lives with the tax payer.
- If the tax payer is claiming a disabled person for the EITC, the tax payer must provide the tax preparer with a written statement from a doctor or other health care provider confirming the person's disability.
If the tax preparer does not perform their due diligence in preparing taxes claiming a a credit, he/she can be fined up to $500 per return. The fine on the tax preparer is not objectively based; thus if the IRS deems the information gathered is not enough or the tax filing seems incorrect (even if the filing is correct), the IRS can impose the fine. The IRS is making the tax preparer the "watch-dog" of all tax credit filings.
